Pancreatitis is a complex, progressively destructive inflammatory disorder. Alcohol was long thought to be the primary causative agent, but genetic contributions have been of interest since the discovery that rare PRSS1, CFTR and SPINK1 variants were associated with pancreatitis risk. We now report two associations at genome-wide significance identified and replicated at PRSS1-PRSS2 and X-linked CLDN2 through a two-stage genome-wide study. The PRSS1 variant likely affects disease susceptibility by altering expression of the primary trypsinogen gene. The CLDN2 risk allele is (...) associated with atypical localization of claudin-2 in pancreatic acinar cells. The homozygous CLDN2 genotype confers the greatest risk, and its alleles interact with alcohol consumption to amplify risk. Current UK legislation is impacting upon the feasibility and cost-effectiveness of medical record-based research aimed at benefiting the NHS and the public heath. Whereas previous commentators have focused on the Data Protection Act 1998, the Health and Social Care Act 2001 is the key legislation for public health researchers wishing to access medical records without written consent. The Act requires researchers to apply to the Patient Information Advisory Group for permission to access medical records without written permission. We present a (...) case study of the work required to obtain the necessary permissions from PIAG in order to conduct a large scale public health research project. In our experience it took eight months to receive permission to access basic identifying information on individuals registered at general practices, and a decision on whether we could access clinical information in medical records without consent took 18 months. Such delays pose near insurmountable difficulties to grant funded research, and in our case £560 000 of public and charitable money was spent on research staff while a large part of their work was prohibited until the third year of a three year grant. We conclude by arguing that many of the current problems could be avoided by returning PIAG’s responsibilities to research ethics committees, and by allowing “opt-out” consent for many public health research projects. Background: A growing literature has raised—skeptically—the question of whether cutting-edge scientific research can identify and address broader ethical and policy considerations in real time. In genomics, the question is: Can ELSI contribute to genomics in real time, or will it be relegated to its historical role of after-the-fact outsider critique? We address this question against the background of a genomic screening project where we participated as embedded, real-time ELSI researchers and observers, from its initial design through its conclusion.Methods: As part (...) of the ELSI study design, the project included an ongoing reflexive ethnography in which the authors studied the process of its design and implementation. The authors were true participant observers, serving as members of various task-oriented groups while recording meetings and other events for ongoing qualitative analysis. We also conducted and analyzed interviews of multiple participants at the conclusion of the project.Results: Our real-time ELSI initiative had a mixed record of successes and challenges. If we define success as ELSI researchers having had an opportunity to participate fully in the project and to make the ELSI perspective heard, then our assessment is largely positive. If, however, we define successes as instances where real-time ELSI contributions changed the direction of the genomic or public health aspects of the GeneScreen project or, after careful deliberation, confirmed the appropriateness of the status quo, then we can identify only a few examples. While we had a seat at the table, we were, for the most part, tolerated guests.Conclusions: We conclude that there are significant barriers to real-time ELSI influence. The difficulty does not reside in any intended exclusion of an ELSI perspective, but in factors endemic to genomic research, including knowledge disparities, epistemological biases, and the pressures of time and money. Despite the controversial nature of studies of reproductive phenomena, a major center of reproductive biology emerged and coalesced in the Department of Zoology at the University of Chicago circa 1892–1940. Led by Frank R. Lillie, several small groups of researchers pioneered the study of sex determination and sex hormones, pursuing these via a Chicago approach to framing biological practice at both cellular and organismic levels. They worked in an interdisciplinary manner, however much in tandem, and drew strongly on local resources—from (...) the stockyards to local philanthropy. Most remarkably, Lillie redirected the mission of the major National Research Council Committee for Research Problems of Sex to address the biology of sex and then garnered about a fifth of its funds for Chicago. He thus guided Chicago biology into the fully modern era of external support for on-campus research and elaborate national scientific networks via promising biological solutions to social problems. En ella la tecnociencia tiene una presencia importante y ésta, a su vez, no es muy diferente con respecto a las demandas intelectuales, culturales y sociales del Barroco. Es decir, en la sociedad actual podríamos decir que sucede lo mismo, interesa más obtener resultados, que se nos asombre, más que comprender el cómo funciona o se realizan. Si bien, como aconteció en el Barroco, sectores de la sociedad emprendieron acciones para dotar (...) de más identidad y cultura a la sociedad e ir en contra de lo institucionalmente establecido. La sociedad actual, se puede decir que es una prolongación del barroco, y nos encontramos en el neobarroco. Este al igual que en el pasado se rebela contra el sistema que sólo está preocupado por la acumulación de dinero, así como contra la ausencia de libertad y, por tanto, contra la represión y la violencia institucionalizada. En definitiva, con este artículo se trata de dar una visión desde la hermenéutica de las similitudes del Barroco con nuestra sociedad actual. ABSTRACT: This paper aims to analyze current society, where techno-science has a major presence while at the same time not differing greatly from that of the Baroque era with respect to intellectual, cultural, and social demands. As in the Baroque era, we are today more interested in getting results than in understanding how things works or how things are done. Also as in the Baroque era, sectors of society are taking action to encourage more identity and culture in society and are going against what is institutionally established. Today we can say that our society is an extension of the Baroque, and that we are in the neo-Baroque era. As in the past, there is now a rebellion against a system that is only concerned with the accumulation of money, as well as a rebellion against the lack of freedom and therefore against repression and institutionalized violence. In short, this article aims to present, from the point of view of hermeneutics, similarities between our current society and that of the Baroque era. (shrink)

In this book, R.E. Allen provides a translation of the 'Parmenides' along with a structural analysis that procedes on the assumption that formal elements, logical and dramatic, are important to its interpretation and that the argument of the Parmenides is aporetic, a statement of metaphysical perplexities.

David Benatar argues that coming into existence is always a harm, and that – for all of us unfortunate enough to have come into existence – it would be better had we never come to be. We contend that if one accepts Benatar’s arguments for the asymmetry between the presence and absence of pleasure and pain, and the poor quality of life, one must also accept that suicide is preferable to continued existence, and that his view therefore implies both anti-natalism (...) and pro-mortalism . This conclusion has been argued for before by Elizabeth Harman – she takes it that because Benatar claims that our lives are ‘awful’, it follows that ‘we would be better off to kill ourselves’ (Harman 2009: 784). Though we agree with Harman’s conclusion, we think that her argument is too quick, and that Benatar’s arguments for non-pro-mortalism deserve more serious consideration than she gives them. We make our case using a tripartite structure. We start by examining the prima facie case for the claim that pro-mortalism follows from Benatar’s position, presenting his response to the contrary, and furthering the dialectic by showing that Benatar’s position is not just that coming into existence is a harm, but that existence itself is a harm. We then look to Benatar’s treatment of the Epicurean line, which is important for him as it undermines his anti-death argument for non-pro-mortalism. We demonstrate that he fails to address the concern that the Epicurean line raises, and that he cannot therefore use the harm of death as an argument for non-pro-mortalism. Finally, we turn to Benatar’s pro-life argument for non-pro-mortalism, built upon his notion of interests, and argue that while the interest in continued existence may indeed have moral relevance, it is almost always irrational. Given that neither Benatar’s anti-death nor pro-life arguments for non-pro-mortalism work, we conclude that pro-mortalism follows from his anti-natalism, As such, if it is better never to have been, then it is better no longer to be. -/- . Should we let personal responsibility for health-related behavior influence the allocation of healthcare resources? In this paper, we clarify what it means to be responsible for an action. We rely on a crucial conceptual distinction between being responsible and holding someone responsible, and show that even though we might be considered responsible and blameworthy for our health-related actions, there could still be well-justified reasons for not considering it reasonable to hold us responsible by giving us lower priority. We transform these (...) philosophical considerations into analytical use first by assessing the general features of health-related actions and the corresponding healthcare needs. Then, we identify clusters of structural features that even adversely affected people cannot reasonably deny constitute actions for which they should be held responsible. We summarize the results in an analytical framework that can be used by decision-makers when considering personal responsibility for health as a criterion for setting priorities. (shrink)

Translational research in medicine requires researchers to identify the steps to transfer basic scientific discoveries from laboratory benches to bedside decision-making, and eventually into clinical practice. On a parallel track, philosophical work in ethics has not been obliged to identify the steps to translate theoretical conclusions into adequate practice. The medical ethicist A. Cribb suggested some years ago that it is now time to debate ‘the business of translational’ in medical ethics. Despite the very interesting and useful perspective on the (...) field of medical ethics launched by Cribb, the debate is still missing. In this paper, I take up Cribb’s invitation and discuss further analytic distinctions needed to base an ethics aiming to translate between theory and practice. (shrink)

In [3] I argued for a particular kind of semantics for subjunctive conditionals. The arguments were based upon some linguistic considerations of the general character of what we mean when we say such and such. I urged that a semantics for subjunctive conditionals ought to provide a distinct representation of the subjunctive mood of a sentence, and should take seriously the fact that subjunctive conditionals admit distinctions of tense. The envisaged semantics took the subjunctive conditional to be about occasions, and (...) the central problem discussed was, accordingly, how to represent what must count as the same occasion in spite of whatever changes were required to make the antecedent of the conditional true. This chapter examimes relevance to misunderstandings about the meaning of aut and possible meanings of ‘or’. In spite of what has been said about the notion of form, there is no harm in applying the word ‘formal’ to the Stoics' work. By some standards, it is not informal, and by those standards, we may therefore call it formal where it is the contrast intended. Since the substitution account of validity would not rule out such disjunctions and a descriptive account would, (...) the descriptive account seems on that score to be the more likely candidate for the Stoic conception of validity. Boole also took exclusivity, even the same arity-free idea of exclusivity, to be centrally important to his representation, but the exclusivity was constructed out of a non-exclusive disjunctive use of ‘or’. The last chapter shows the use of ‘or’ as an adverb. The discourse-adverbial view invites us rather to think of each clause as formulaically giving permission rather than asserting permissibility. Discourse adverbial uses of ‘or’ may be regarded as the most primitive uses. The invention of logic, or rather the many inventions of logic, for it has been invented many times, has always involved the suspension of some regularities governing the uses of ‘and’, ‘or’, ‘not’, ‘if, ‘possibly’, and so on (...) in favor of others. Traditional grammar and its late offspring represent one possible way of describing and representing discourse, howsoever fragmentarily. Our understanding of discourse ought to be measured, not in our understanding of that isolated path, but in the multiplicity of other possible paths that we are also capable of recognizing. (shrink)

This chapter talks about how philosophers define and use the word ‘or’ and how the word ‘or’ has undergone changes in modification. The notion of logical form does not apply straightforwardly to sentences of natural language. A sentence has no logical form independently of a specification of a formal language of representation. There is a sense in which the whole meaning of the inclusive “or” is only part of the meaning of the exclusive “or”. According to Boole's Rule, and-lists of (...) general terms represent unions in the subject place; or-lists of general terms represent unions in the predicate place. A unified semantic account of or, and a uniform semantics of natural language connectives more generally must depend upon an abandonment of both assumptions. (shrink)

This aim is achieved through a discussion ofthe goals and objectives of evidence-basedmedicine and a review of the criticisms raisedagainst evidence-based medicine. Thecontributions to informal logic by StephenToulmin and Douglas Walton are explicated andtheir relevance for evidence-based medicine isdiscussed in relation to a common clinicalscenario: hypertension management. This essayconcludes with a discussion on the relationshipbetween clinical reasoning, rationality, andevidence. The thesis of this article is that there has never been any ground for the controversy between the doctrine of free will and determinism, that it is based upon a misapprehension, that the two assertions are entirely consistent, that one of them strictly implies the other, that they have been opposed only because of our natural want of the analytical imagination. In so saying I do not tamper with the meaning of either phrase. That would be unpardonable. I mean free (...) will in the natural and usual sense, in the fullest, the most absolute sense in which for the purposes of the personal and moral life the term is ever employed. I mean it as implying responsibility, merit and demerit, guilt and desert. I mean it as implying, after an act has been performed, that one " could have done otherwise " than one did. I mean it as conveying these things also, not in any subtly modified sense but in exactly the sense in which we conceive them in life and in law and in ethics. These two doctrines have been opposed because we have not realised that free will can be analysed without being destroyed, and that determinism is merely a feature of the analysis of it. And if we are tempted to take refuge in the thought of an "ultimate ", an "innermost" liberty that eludes the analysis, then we have implied a deterministic basis and constitution for this liberty as well. For such a basis and constitution lie in the idea of liberty. -/- The thesis is not, like that of Green or Bradley, that the contending opinions are reconciled if we adopt a certain metaphysic of the ego, as that it is timeless, and identifies itself with a desire by a " timeless act". This is to say that the two are irreconcilable, as they are popularly supposed to be, except by a theory that delivers us from the conflict by taking us out of time. Our view on the contrary is that from the natural and temporal point of view itself there never was any need of a reconciliation but only of a comprehension of the meaning of terms. (The metaphysical nature of the self and its identity through time is a problem for all who confront memory, anticipation, etc.; it has no peculiar difficulties arising from the present problem.) -/- I am not maintaining that determinism is true; only that it is true insofar as we have free will. That we are free in willing is, broadly speaking, a fact of experience. That broad fact is more assured than any philosophical analysis. It is therefore surer than the deterministic analysis of it, entirely adequate as that in the end appears to be. But it is not here affirmed that there are no small exceptions, no slight undetermined swervings, no ingredient of absolute chance. All that is here said is that such absence of determination, if and so far as it exists, is no gain to freedom, but sheer loss of it; no advantage to the moral life, but blank subtraction from it. -- When I speak below of "the indeterminist" I mean the libertarian indeterminist, that is, him who believes in free will and holds that it involves indetermination. 2. The Meno offers a dramatic demonstration of the validity of the first argument put forward for Anamnesis and the immortality of the soul in the Phaedo.

A modified version of Young’s experiment by Shahriar Afshar indirectly reveals the presence of a fully articulated interference pattern prior to the post-selection of a particle in a “which-slit” basis. While this experiment does not constitute a violation of Bohr’s Complementarity Principle as claimed by Afshar, both he and many of his critics incorrectly assume that a commonly used relationship between visibility parameter V and “which-way” parameter K has crucial relevance to his experiment. It is argued here that this relationship (...) does not apply to this experimental situation and that it is wrong to make any use of it in support of claims for or against the bearing of this experiment on Complementarity. This study represents an improvement in the ethics scales inventory published in a 1988 Journal of Business Ethics article. The article presents the distillation and validation process whereby the original 33 item inventory was reduced to eight items. These eight items comprise the following ethical dimensions: a moral equity dimension, a relativism dimension, and a contractualism dimension. The multidimensional ethics scale demonstrates significant predictive ability.

Francis Fukuyama, in his Our Posthuman Future, and Gregory Stock, in his Redesigning Humans, present competing versions of the biomedical future of human beings, and debate the merits of more or less stringent regimes of regulation for biomedical innovation. In this article, these positions are shown to depend on a shared discourse of market liberalism, which limits both the range of ends for such innovation discussed by the authors, and the scope of their policy analyses and proposals. A proper evaluation (...) of the human significance and policy imperatives for biomedical innovation needs to be both more utopian in its imagination, and more sophisticated in its political economy. In essence, the Fukuyama/Stock debate tells us more about current US political ideology than it does about the morality of human genetic and biopsychological engineering. (shrink)

Clinical ethical support services (CESS) represent a multifaceted field of aims, consultancy models, and methodologies. Nevertheless, the overall aim of CESS can be summed up as contributing to healthcare of high ethical standards by improving ethically competent decision-making in clinical healthcare. In order to support clinical care adequately, CESS must pay systematic attention to all real-life ethical issues, including those which do not fall within the ‘favourite’ ethical issues of the day. In this paper we attempt to capture a comprehensive (...) overview of categories of ethical tensions in clinical care. We present an analytical exposition of ethical structural features in judgement-based clinical care predicated on the assumption of the moral equality of human beings and the assessment of where healthcare contexts pose a challenge to achieving moral equality. The account and the emerging overview is worked out so that it can be easily contextualized with regards to national healthcare systems and specific branches of healthcare, as well as local healthcare institutions. By considering how the account and the overview can be applied to i) improve the ethical competence of healthcare personnel and consultants by broadening their sensitivity to ethical tensions, ii) identify neglected areas for ethical research, and iii) clarify the ethical responsibility of healthcare institutions' leadership, as well as specifying required institutionalized administration, we conclude that the proposed account should be considered useful for CESS. Ved å videreføre H. Grimen og A. Molanders anvendelse av S.E. Toulmins modell for praktisk resonnering i en klinisk kontekst redegjør jeg for legeskjønnets multidimensjonale, epistemiske struktur. Gjennomgangen viser hvordan skjønnsanvendelse i legerollen kan analyseres i henhold til en fagteknisk, en distributiv og en relasjonell dimensjon. Mot denne bakgrunnen diskuterer jeg så (...) spenninger som oppstår i skjæringspunktet mellom strukturering og kultivering av skjønnets ulike dimensjoner. By developing H. Grimen and A. Molander's application of S.E. Toulmin's model for practical reasoning in a clinical context, the multi-dimensional epistemic structure of the physician's judgment in terms of technical, distributive, and relational judgment is accounted for. Against this backdrop, tensions emerging in the intersection between delimitation and cultivation of professional judgment in its various dimensions are discussed. The discussion clarifies that the medical profession is not a self-sufficient provider when it comes to ensuring an adequate cultivation of its members' judgment in a clinical context. It is argued that by emphasising and implementing the relevant external contributions to the profession's ongoing self-regulation, the public's justified trust in the medical profession can be strengthened. Translational ethics (TE) has been developed into a specific approach, which revolves around the argument that strategies for bridging the theory‐practice gap in bioethics must themselves be justified on ethical terms. This version of TE incorporates normative, empirical and foundational ethics research and continues to develop through application and in the face of new ethical challenges. Here, I explore the idea that the academic field of bioethics has not yet sufficiently analysed its own philosophical foundation for how it can, and (...) should, be practically relevant; neither has it comprehensively discussed the limitations on what impacts bioethicists should pursue. As a result, there has not been adequate training on how to suitably and appropriately impact real‐world practices. Moreover, bioethical perspectives are often competing with other strong interests, for example, economic and political, which may weaken their impact on policy‐making. The TE approach I propose can not only facilitate practical impacts of academic bioethics by being better informed by real‐world ethical issues but it also supports targeted and ethical justifications of the actual impact of academic work in real‐world contexts. In this paper, I clarify the premises for this TE approach, identify further challenges and sketch out potential solutions for the implementation of this methodological framework. (shrink)

An apparent paradox proposed by Aharonov and Vaidman in which a single particle can be found with certainty in two (or more) boxes is analyzed by way of a simple thought experiment. It is found that the apparent paradox arises from an invalid counterfactual usage of the Aharonov-Bergmann-Lebowitz (ABL) rule and effectively attributes conflicting properties not to the same particle but no different particles. A connection is made between the present analysis and the consistent histories formulation of Griffiths. Finally, a (...) critique is given of some recent counterarguments by Vaidman against the rejection of the counterfactual usage of the ABL rule. (shrink)
